Egypt Pediatrician on H-1B Achieves His Green Card Because of His Exceptional Medical Center Performance

From 2018 onward, the Margaret W. Wong team in Cleveland very much enjoyed working with Dr. Magby, a very gentle and well-mannered pediatrician who had chosen to immigrate to the United States from Egypt.

Accordingly, we worked with the clinic in Northeast Ohio and first secured for Dr. Magdy an H-1B visa in 2018. Then, after his PERM was approved in April of 2020, we obtained an I-140 (Immigrant Petition for Alien Worker) in July of 2020 and immediately filed an I-485 (Application for Legal Permanent Residency).

Certainly, we also secured for him an Employment Authorization Document that we renewed at the appropriate time.

In 2020, Dr. Magby faced a choice, he had indicated to those at the clinic, that had continuously sponsored him throughout his resettlement process, that he would remain there indefinitely, but then he received an offer to go to work for a larger medical center that offered to pay him more money.

For sure, leaving the clinic would be a violation of the H-1B procedure but the medical center had the connections to obtain for him another one without too much of a problem. Along these lines, he also had the EAD which would enable him to work for the medical center plus the fact that he applied for a green card over 100 days earlier would allow him to also work for the medical center if he stayed in pediatrics which he planned to do anyway but after he got his green card, he could practice in whatever area he wanted.

Nevertheless, after thinking about it for a while, Dr. Magby chose to fulfill his commitment and remain with the clinic which he honestly believed needed him more.

Thus, those of us at Margaret Wong’s were particularly glad when Dr. Magby received his green card in February of 2021, and we looked forward to working with him throughout the process that would culminate when he would become a U.S. citizen in just a few years.
