    ELEVENTH CIRCUIT VICTORY IN FALUN GONG CASE - On January 12, 2009, the Eleventh Circuit granted our Petition for Review on a case where the BIA denied our client's motion to reopen to allow her to apply for asylum based on changed circumstances in China. Our client's asylum application was denied in 2001. Subsequently she started practicing Falun Gong in the United States. We filed a Motion to Reopen with the Board of Immigration Appeals arguing that her case should be reopened based on a change of country conditions in China with respect to the treatment of Falun Gong practitioners. We argued that Chinese Government increased its enforcement of its prohibition against the practice of Falun Gong in China since 2001. We also submitted evidence to support our argument. We argued that this was not merely a change in personal circumstances but a change in country conditions that warranted reopening. The BIA denied the Motion and we appealed to the Eleventh Circuit. After considering the arguments, the Eleventh Circuit issued a decision stating that the evidence we submitted established a change in conditions with respect to China's increased persecution against Falun Gong practitioners. The Eleventh Circuit found that the Motion should have been granted and remanded the case to allow our client to apply for asylum and withholding of removal. Scott Bratton handled the case. Liu v. U.S. Attorney General, 2010 WL 93273 (11th Cir. 2010)

    I-765 Employment authorization under the C09 category was received for processing on December 1, 2009 and approved on January 13, 2010. USCIS is working hard.

    Senior Attorney Lori Pinjuh made the American Immigration Lawyer's Association (AILA) list of being a member of their organization for at least 10 years.

    Scott Bratton successfully argued a case in front of the 6th Circuit! The issue was whether there are circumstances where BIA has jurisdiction to hear appeals of MTRs after a person was deported. The regulations indicate against this, but the court agreed with our Firm's stance that at least under the facts of our case that the BIA does have jurisdiction. This is big win not only for this particular case, but will have an impact on others. The case decision was published.
