We Worked with HR Department to Bring Nicaragua Mathematician on H-1B When Lottery Gave Her the Chance to Work in the USA

From early 2016 onward, the Cleveland office of Margaret W. Wong & Associates LLC worked with a young mathematician from Nicaragua named Karly obtain an H-1B visa and later an extension.

Initially things did not go well for Karly because even though she had located a foundation that wanted to support her, she was not selected in the 2016 lottery. She needed to find another way to remain in the United States, so we recommended that she enroll in another program related to her field of study that took place at a local community college to retain her F-1 student status.

In 2017, our team worked with the HR department of the before-mentioned foundation which filed the H-1B lottery petitions and in May of 2017, Karly was selected in the H-1B lottery and in August she was approved for an H-1B that would run from October of 2017 to September of 2020.

Our team continued to work with HR and in April of 2019 the PERM job description was finalized, and the prevailing wage was submitted. In December of 2019, the prevailing wage determination was received and in April of 2020 the LCA (Labor Condition Application) was submitted to the DOL (Department of Labor).

By that time Karly was midway through the PERM process with ads running for other qualified applicants but no one applied with anything close to Karly’s qualifications.

Then, at the end of May of 2020, we filed PERM to the DOL and Karly’s H-1B was renewed from September of 2020 to September of 2023.
