Our client was placed in removal proceedings in Chicago, Illinois after ICE came to his residence. His wife had a final order of removal. Our client and his wife have two children born in the United States. We filed an application for cancellation of removal with the Immigration Court. We presented evidence to establish that our client met the legal standard for cancellation of removal, including that his removal would result in exceptional and extremely unusual hardship to his children. One of the children had just started seeing a psychologist in New York. The Court held two hearings on the application and each hearing lasted over three hours. We presented the testimony of 5 witnesses, including the child’s psychologist. In November 2013, the Immigration Judge granted the application for cancellation of removal in a detailed, written decision. This was an extremely hard fought victory by Scott Bratton.
