Syrians' TPS Extended Through September 30, 2016

USCIS (U.S. Citizenship and Immigration Services) posted in the January 5, 2015 Federal Register, that Secretary of Homeland Security Jeh Johnson announced an 18-month TPS (Temporary Protected Status) extension for Syrians eligible for TPS. Employers. Those who enjoy TPS EADs (Employment Authorization Documents) from the 2012 Syrian designation and the 2013 redesignation, may re-register from January 5, 2015 through March 6, 2015.  "USCIS will issue new EADs with a September 30, 2016 expiration date to eligible Syria TPS beneficiaries who timely re-register and apply for EADs under this extension" -- though USCIS also recognizes that not all re-registrants will received their new EADs prior to expiration of their current EADs. Therefore this notice also automatically extends EAD expiration by 6 months through September 30, 2015. Employers and individuals may reference the DHS notice to help determine applicability of their EAD expirations, "and their impact on Employment Eligibility Verification (Form I-9) and E-Verify processes." Those currently without TPS have 180 days from January 5, 2015 through July 6, 2015 to apply for initial TPS, using a new Application for Temporary Protected Status (Form I-821). Eligibility criteria include:

  • Continuous residence in the United States since January 5, 2015, and
  • Demonstrate continuous physical presence in the United States since April 1, 2015

Pending Need Not Refile. Pending initial applications under the 2012 TPS designation and 2013 redesignation will be continue as initial applications through the 2015 redesignation.  Those with pending applications should seek additional instructions from DHS should they wish to apply for EADs.
