Multiple felonies – alien eligible to get us citizenship

Negotiated a plea

Our client was convicted in state court of multiple felonies in 1991. Although he was granted a waiver for these cases in Immigration Court, he was unable to naturalize because they were considered to be aggravated felonies. We filed a motion to vacate in state court alleging that neither the court nor our client’s attorney informed him of the adverse immigration consequences of his plea. At his hearing on the motion, the court found that the motion should be granted and vacated the aggravated felony convictions. We negotiated a plea to one misdemeanor that will not have immigration consequences. Our client is now eligible to naturalize. Scott Bratton handled the case.
