Parole in Place Plan for Undocumented Spouses Announced

Parole in Place Plan for Undocumented Spouses Announced

On Tuesday, June 18, President Biden announced a parole in place initiative that would provide a pathway to legal status for undocumented spouses of U.S. citizens. He described the plan as a practical solution for more than half a million mixed‑status families living in the United States. The announcement comes as the administration addresses rising public concern over migration at the southern border. At the same time, it seeks to respond to criticism from progressive Democrats and Hispanic leaders over restrictive asylum policies.

The initiative also includes provisions for certain children of undocumented individuals who are married to U.S. citizens. Biden emphasized his commitment to family unity. He contrasted his approach with policies from the Trump administration that resulted in family separations.

Biden announced the plan during a White House event marking the 12th anniversary of the Deferred Action for Childhood Arrivals (DACA) program. DACA currently protects nearly 530,000 undocumented individuals who were brought to the United States as children from deportation.

According to the Department of Homeland Security, about 500,000 undocumented spouses and 50,000 children under the age of 21 may qualify under the initiative. Eligible individuals must have lived in the United States for at least 10 years as of June 17. They must also be legally married to a U.S. citizen. There is no minimum length of marriage requirement. However, eligibility is limited to those who met all conditions by that date.

Parole in Place Eligibility and Status Adjustment

Under current immigration law, individuals who entered the United States without inspection usually must leave the country to apply for lawful permanent residence after marrying a U.S. citizen. That process often takes several years. In many cases, it leads to extended family separations. Under the new policy, qualifying individuals could instead seek legal status while remaining in the United States.

The administration stated that the initiative aims to reduce hardship for families with long‑standing community ties.

Parole in Place and Additional Immigration Measures

In addition to the parole in place initiative, Biden announced measures to streamline the employment visa process for certain undocumented college graduates. These measures may affect individuals who earned degrees from U.S. institutions. They include some DACA recipients and other Dreamers.

To qualify, applicants must receive a job offer in a high‑skill position. The administration said these steps are designed to retain talent educated in the United States.

The White House emphasized that it pursued executive action because Congress has made little progress on immigration reform. Republican lawmakers have opposed broader citizenship pathways and expanded work authorization for undocumented individuals. Earlier this year, a bipartisan border agreement failed to advance. That proposal did not include provisions for expanded legal status or employment visas.

Political and Legal Response

The announcement has prompted strong political reactions. Supporters say the initiative reinforces family unity. They also argue that it counters claims that the administration has adopted overly restrictive immigration policies. Republican lawmakers, however, have criticized the plan. They describe it as amnesty and argue that it is politically motivated.

Former President Donald Trump has renewed pledges to pursue large‑scale deportations if re‑elected. He has criticized Biden’s immigration policies. He has also gained public support among some voters, including segments of the Latino electorate.

Biden has responded by warning that Trump’s proposals could revive family separation policies. Republican‑led states are expected to challenge the initiative in court. House Speaker Mike Johnson has questioned the plan’s legality. The White House maintains that the initiative falls within existing executive authority.
