State Department Updates Interview Waiver Policy

The U.S. State Department has introduced an update to its interview waiver policy for nonimmigrant visa applicants. The revised framework replaces the temporary measures used over the past three years and establishes a standing policy subject to annual review. According to the department, the update is intended to provide greater predictability and reduce uncertainty for applicants and other stakeholders.

Under standard rules, nonimmigrant visa applicants between the ages of 14 and 79 must attend an in‑person interview at a U.S. embassy or consulate. However, existing law allows interview waivers in limited situations, including cases involving national interest considerations or unusual circumstances. These waivers have been used to prioritize low‑risk applicants and applicants from Visa Waiver Program countries.

Use of Interview Waivers Over Time

Historically, interview waivers have been implemented to support economic and operational goals. For example, in 2012, the Obama administration expanded waiver use to increase foreign visitor travel. That program was later suspended in 2017 following a change in administration.

During the COVID‑19 pandemic, the Trump administration relied on interview waivers to facilitate the entry of temporary workers, particularly in agriculture, as consular staffing and processing capacity declined.

Later, in response to growing visa backlogs, the Biden administration broadened waiver eligibility in 2021. The expansion covered student and academic exchange visitor visas and was later extended to additional categories, including specialty occupation (H‑1B), intracompany transferee (L), extraordinary ability (O), athlete, artist, and entertainer (P), and cultural exchange (Q) visas.

Impact on Visa Processing

According to the State Department, interview waivers significantly reduced consular wait times. Last year, approximately 40% of the 10.4 million nonimmigrant visas issued were processed through interview waivers. In Mumbai, for example, student visa wait times dropped from 49 days to seven days between November 2022 and August 2023.

As the previous waiver authority approached its December 31, 2023 expiration date, industry groups and educators urged its continuation. They cited benefits for international student enrollment, foreign visitor spending, and overall processing efficiency.

Revised Policy Effective January 1, 2024

In a late‑stage announcement, the State Department confirmed an updated interview waiver policy effective January 1, 2024. The revised policy continues to allow waivers for first‑time applicants in certain work visa categories, including H‑2 visas. It also extends eligibility to applicants who previously held any nonimmigrant visa, other than a visitor visa, within 48 months of expiration.

Applicants renewing a visa in the same category within 48 months of expiration remain eligible for an interview waiver. However, the policy excludes first‑time nonimmigrant visa applicants from Visa Waiver Program countries. Visitor visa applicants and individuals whose prior nonimmigrant visas expired more than 48 months ago are also excluded.

Legislative Proposals and Ongoing Demand

Several lawmakers have introduced bills that would codify similar waiver language into U.S. law. These include the Visa Processing Improvement Act and the H‑2 Improvements to Relieve Employers (HIRE) Act.

While no legislation has yet been enacted, the State Department has emphasized that the standing interview waiver policy remains an important tool. As visa demand continues at historically high levels, the department expects the policy to remain central to managing processing times for travelers to the United States.
