USCIS Announces Premium Processing Fee Increase

U.S. Citizenship and Immigration Services announced on December 27 that it issued a final rule. The rule will increase the filing fee for Form I‑907, Request for Premium Processing. This change is designed to adjust the fee for inflation.

The USCIS Stabilization Act created the current premium processing fees. It also granted the Department of Homeland Security the authority to adjust these fees every two years. DHS did not change the fees for three years after the Act’s passage. Now, DHS is raising premium processing fees for all eligible forms and categories. This processing fee increase reflects inflation measured by the Consumer Price Index for All Urban Consumers. The CPI calculation covers the period from June 2021 through June 2023. Under the new rule, specific fees will rise from $1,500 to $1,685. Other fees will increase from $1,750 to $1,965. The highest tier will increase from $2,500 to $2,805.

DHS will use the additional revenue to support premium processing services. It will also make improvements to adjudication processes. The increased funds will help USCIS respond to case demands. These efforts include reducing benefit request backlogs. The revenue will also support other USCIS adjudication and naturalization services.

The fee change will take effect on February 26, 2024. Applicants using the current lower fees should submit their forms by February 25, 2024. Forms must also be postmarked no later than that date. If USCIS receives a Form I‑907 with the wrong fee on or after February 26, 2024, it will reject the filing. The agency will then return the payment. For filings sent by commercial couriers such as UPS, FedEx, or DHL, the postmark date will match the courier receipt.
