USCIS Expedited EAD Renewal Option for Healthcare Workers
Effective December 28, 2021, USCIS announced a new option for USCIS expedited EAD renewal requests. Eligible healthcare workers with pending EAD renewal applications may now request faster processing if their EAD is expired or will expire within 30 days. This update aims to support essential workers facing long delays.
To qualify, applicants must meet three requirements: they must be healthcare workers, have a pending Form I‑765 renewal, and hold an EAD that is expired or expiring soon.
Who Qualifies as a Healthcare Worker?
USCIS directs applicants to an August 10, 2021 DHS memorandum to confirm healthcare worker status. The list is broad and includes far more than doctors and nurses.
Qualifying occupations include:
- Dentists, psychologists, speech pathologists, nutritionists, and occupational therapists
- Pharmacists and pharmacy staff
- Long‑term care facility workers
- Home care workers
- Medical center staff, including sanitation workers, security guards, food service workers, and shuttle drivers
- Social workers and mental health counselors
- Individuals providing care for older adults or people with disabilities
- Medical researchers and laboratory workers involved in disease research
- Telehealth workers
- Mortuary and funeral home workers
The DHS list spans pages 7–9 under “Healthcare/Public Health.”
How to Request USCIS Expedited EAD Renewal Processing
If you meet the criteria, you may call the USCIS Contact Center at 800‑375‑5283 (TTY 800‑767‑1833). USCIS will review your request and determine if it qualifies for expedited handling.
Applicants should be ready to provide evidence of their healthcare worker status. USCIS has not explained how it will verify this status, so strong documentation is essential.
Documents Needed for an Expedited Request
USCIS recommends preparing proof of your profession or current employment. If evidence is insufficient, USCIS may deny the expedite request. At minimum, have:
- A copy of your expired or soon‑to‑expire EAD
- Your EAD renewal receipt number from your I‑797C notice
- Your job title and employer name
- Proof of current healthcare employment, such as pay stubs, an ID badge, or a professional license
These documents help USCIS confirm eligibility for USCIS expedited EAD renewal processing.
How Much Faster Will Processing Be?
USCIS has not stated how much faster an expedited request will be processed. However, current EAD renewal delays can reach 14 months or more. Because of these unpredictable timelines, eligible healthcare workers are strongly encouraged to request expedited processing.
This option may also reassure individuals in categories like C(09) and C(08), who qualify for an automatic 180‑day extension if they filed their renewal before their EAD expired.
